I had a letter stuffed through my door today saying that my three jags and an astra(number2 son's) have been seized.
all this cos my number one son didnt pay a 60 quid parking fine and now owes 500 and summat...

can the bailifs do this?

You need to tell the bailiffs that they cannot seize your cars because you are not (or were not) the registered owner of the vehicle which incurred the parking offence and demand that they withdraw that notice and apologise for the stress they have caused you.
Everything else follows from that but knowing how stupid / ignorant / obstinate these bailiffs can be in the hope of scaring someone in to giving them money, you may want to talk to the CAB or a solicitor.

The next thing you know, your credit rating will get a black mark because you have a court order against your name!

Mmmmmm ... Roly hasn't posted for the last 36 hours or so.
Do you think he has been seized by the bailiffs and being held for ransom until his son's fine has been paid??? 

Trouble is with a DD to Baliffs is the Baliffs get all the dosh and the debt with the original company actually gets left unpaid 

If he pays the company he actually owes the money to then ultimately he will clear the debt and the Company will have to call off the Baliffs 

As regards a DD with the bank normally what happens, or at least in my world of Banking is that a temporary overdraft is put in place, charges delayed till debt is clear and account back in credit 

Bear in mind if he sets up a DD with the Baliffs, he is, in effect giving them Carte Blanche to dip into his account and take whatever amount they want, when they want  A Standing Order would be a better option as he remains in control so long as he has the funds available on the due date

I have 'shock alerts' on all of the windows in the house so that if anyone tries to break the glass an ear piercing 'shriek' is emitted. They are so sensitive, a sharp tap will set one off, so now, when I get those nuisance phone calls from a number I don't recognise on the caller ID, I lift the phone and without saying anything, walk over to a window and tap the shock alarm while holding the phone mouthpiece close to it.

Hopefully it bursts their eardrums!

I've just tried another one on seeing an incoming call ID'd as 'INTERNATIONAL Out of Area".

I picked up the phone and announced "Police - , phone fraud office - Please hold the line until we have traced this call".

Funnily enough, after a few seconds of coughs and splutters, the line went dead. 

I also have great fun with the Asian gentlemen who claim to be from the technical department of Microsoft telling me there is a problem with my computer and would I mind doing some checks so that they can correct it. I can keep them talking for ten minutes or more spouting complete BS, finally telling them that I don't actually have a computer! 

We had the Police banging loudly on the door 12:40 am Tuesday wanting to talk to Ralph.

Apparently they had stopped a van bearing Ralphs Berlingo's number plates and wanted to ask Ralph a few questions.

Bit worrying really why they picked on him considering about 8 or 9 years ago there was another vehicle he had spotted bearing the same plates as his company van of the time 

The Police wont have Ralphs mobile number 

Perhaps but dont want to make a big deal of the incident as Ralph has got far more stuff to fret about at the moment regarding his family 

Definitely not a criminal if you ignore him being banned for life from hiring any venue from Leeds Council when he was 17 because he hosted a pre Christmas party where the guests (mainly unknown gatecrashers he couldnt easily keep out) trashed the Community Centre he had hired.

Wonder if Leeds Council would stop him if he tried hiring now. I suspect they would not have kept a record of that minor indiscretion for that long

Roly, I have a bad feeling this is going to end in tears, there is no easy way out, the finance company (loan shark) will want their money back, plus extortionate interest rate, so you either pay up for a loan you didn't have or put no 1 son in the frame, neither of which is going to be pleasant, I think a quiet word in his shell like would be my first action.

right these "payday direct "people state that the applicant must be in work and must tell them about any debt relief orders etc. well ben has one of those so he is technically bankrupt.....
also the bank account used.. the loan went to must also be the same account his "wages" are paid into..... so i wonder if they can draw on his account.

i had another letter today from a finance company.. asking me if i had applied for a loan as they thought it was I.D. fraud... put them in the picture. it is good when some of these firms are on the ball. i have now had it flagged with the experians of this world etc.. that there is a possibilty of i.d. fruad.

Think you develop a sixth sense where fraudsters are concerned. I imagine these loan people are probably far more finely tuned to it than I would be though I am normally pretty sharp.

Voice on the end of the telephone just doesnt match the profile of the customer details you have in front of you or accent not in keeping with the name on the account. 

well i had no calls on Sunday but they started on the bank holiday... the last call at 21.50 hours... i answered this one and laid into them... it was a payday company loan shark.... i ended up telling them to "go forth and multiply",
As for dick darstardly.. he  has been telling me ever since he came here that he was gonna move in with his mate.. when this other lodger had gone.... and he is now going... so ive been telling number 1 to get packing... but as expected(more bloody lies)suddenly there is a problem as his mate may not be renting the room now... its all total rubbish... number 1 has today started a new job as a welder today... dont know what he knows about welding... but he is a car mechanic....
the next calls i get and somebody speaks and dont jst put the phone down as soon as i answer... then i will pretend to be him... see what they want.

well Nick I have done the polite bit(so far) had four calls.... told them I don't know this person and he must be a fraudster and conning money off people like you.... then then say thats intersting and phone off.One of the callers was Amercian and the last one was an Asian bidenwally which was hard to understand.... after I did my bit...he asked me if I have any debt problems he could help me with!

I heard a radio program yesterday on "you and yours radio4". about these payday loans chaps... seems they don't do credit checks.
Anyway today I received a letter from Sainsbury's loans saying I had applied for a loan and they wanted more details. Told them I hadn't etc... but they"can't give me details of the loan I had applied for".I asked why not as it is in my name!!!. Anyway i did manage to get out of them that the date of birth was different. But they did say they would coperate with the police as I told them I am collecting a dossier.
In that radio prog it did say that the police are interested unless the decption is over £5000.

I ordered a 2nd credit report ..this time from experian. I have 4 loan searches on there... two with different dates of birth... the dates of birth on there are one digit out from number 1 son's DOB.
The payday loan is on there... payday express.. he has to pay it by the 10th of Sept.... he has no chance. Now the date of birth is not quite the same ..now do I prove it is him??

These are the two on my credit report. the third one is "TXT IT OU" but i can't find anything about them.
I have emailed the lendingstream one as to why they did a search on me and did they lend"me" money.

Having a bank account or debit card doesnt denote credit worthiness. Some accounts like Santander Basic Account you can have direct debits on and standing orders but you dont get credit checks when you open them. The Instant Plus account is similar though dont think this is an account Santander now do is similar and does have what was an Electron card but we now call it an online visa.

These types of account are designed for people with poor credit ratings or bankrupts so dont come with facilities like overdrafts or chequebooks but its still possible to go overdrawn in them.

Personally I think every account that carries a debit card of any description should be credit scored but they even give debit cards to children now from the age of about 11 upwards but if they are under 18 years of age they dont get bank charges.

I really think we should go back to the old days when most people with low credit ratings only got a cash card even on full current accounts. It would certainly make my working life so much easier as its scary how many people just havent got a clue about what goes on in their account and rely on their card maybe being declined before they start worrying.

Unfortunately with merchants having floor limits where a small transaction will go through without the card going through to be authorised at the point of sales it is all too easy.

Trouble is with payday loans because of the interest rates etc people take out more and more of them just to try and pay off the others and live then complain when their wages or benefits immediately get grabbed by the payday loan companies who are relentless in putting through authorisations several times a day till they get something out of the person.

So far as I am aware though the money does have to be paid into the account it gets debited from so keep a close eye on your card Roly and ensure no 1 doesnt know your pin number but I am sure I dont really have to tell you that 

I have had a password put on the credit ref agencies now so anyone wanting to lend me money must be given the password.... of course it will make my life harder if i need credit... but i don't.

Working in Banking Customer Services as I do I deal daily with folk complaining that these payday loan companies have debited their accounts unlawfully or agreements have been put in place so do know a bit on the subject.

I am always happy to share my knowledge on the subject but am pretty sure these people borrowing money cannot nominate an account to be debited which isnt the account money was paid in to 

Roly, I really hope you have hidden your card well away from no 1 son and he doesnt know your pin number else you will be truly knackered.

I have heard so many excuses from my customers as to why these companies shouldnt debit their accounts it is unreal. But then I hear complete crap and excuses from customers every day but now and then there is a spark of originality in them which make me smile 

The phonecalls have started again today...

When I had trouble with an organisation who failed to do what they promised to do in various telephone conversations - and then denied that anyone had promised me anything - I started to record all phone conversations. I also carried a concealed miniature recording device (old fashioned tape Dictaphone) when attending a meeting in their office.

All went well until in the middle of the meeting, the tape ran out in the Dictaphone and the thing started loudly 'bleeping' a warning.  I had the presence of mind to mutter "Damned phone" and reached in to my pocket to switch it off.

Fortunately I had enough on tape to prove they had been conning me and a threat to send the transcripts to the newspapers resolved the situation in my (financial) favour!

Get yourself a digital recording device which you can hook up to the phone, just in case they renege on their promises - don't trust any of them!

Having said previously that I didnt think it possible to have credits into one bank account and debits from another I wound up on my last call of today with just such a scenario so may be forced to eat my words on the previous statement.

A guy had card debits from Wonga totalling in the region of £900 which he was disputing. Problem is probably going to be we blocked his card  and reissued it on Saturday after he had confirmed the transactions as genuine with Fraud. Today he was disputing that statement so will either need to take matter up with Wonga directly due to the standard alert on account saying transactions confirmed which means that in all probablility like in excess of 90% of disputes raised against payday loan companies it gets thrown out by fraud/disputes almost straight away

This call after 50 mins still unresolved and had to be passed to my line manager who is new to Banking department though not Management or the company and really has very little knowledge of processes or what we do for call back after previous calls hopefully traced and assessed for content 

If I were to hazard a guess I would say person had a loan credited to one account and said something like lost card or closed account to Wonga and gave them alternative account but unconvinced as to where the money actually went in. Account movements generally largish transfers in from another account
